1. Introduction to Everleads’ Services

Everleads is a trade name registered as a DBA ('Doing Business As') under the Colorado corporation ListsOnline.com, Inc. (ListsOnline). ListsOnline is currently transitioning its database business to operate under the Everleads trade name. We may also conduct business as described on this website under the ListsOnline name/brand.

Everleads offers a range of data marketing and analytic services and products primarily focused on businesses, business contacts and professionals. These solutions help our clients, along with their platforms and partners, deliver more relevant marketing and gain deeper insights into their data.

The Privacy Policy provided here covers the privacy policy for Everleads, ListsOnline and all affiliated entities including additional DBA’s as listed in the “Entities Covered in this Privacy Policy” section below. We provide this Privacy Policy as a service to consumers and others who want to learn more about the data we handle and how we use it.

2. The Types of Data That We Collect, Store and Use

Everleads’ focus is on business and professional data not consumer data. We work with data that we obtain from public domain sources. These sources include state and federal government business and professional public record filings and registrations, public financial filings, public social network listings, industry-focused news and business publications and public-facing websites. We also may obtain public domain data through third party data compilers and suppliers.

All of the data Everleads sources, stores and use is “publicly available” which is

(I) Information that is lawfully made available from federal, state, or local government records and/or,

(II) Information that is lawfully made available to the general public by the consumer or from widely distributed media.

Some of the data we receive and use includes name, postal address, telephone number and/or email address. We also receive and use professional information, including occupation and job title. In addition, some of our services involve using and making available “business to business” (“B2B”) data, which is obtained from a number of sources, including government business filings and records, public domain directories, publications and third party data suppliers.

This privacy policy addresses both information collected from the public domain sources described above and through this website. However, most of the information that we handle is not collected on this website. If you are interested particularly in the information we collect on this website, please go to the Section below titled “Data Collected On Our Website.”

3. Types of Data That We Do NOT Collect, Store or Use

Everleads does NOT collect, store or use sensitive data. “Sensitive data” (as defined in the Colorado Privacy Act C.R.S. §§ 6-1-1301) means the following:

(i) personal data revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sex life or sexual orientation, or citizenship or citizenship status;

(ii) genetic or biometric data that may be processed for the purpose of uniquely identifying an individual;

(iii) personal data from a known child; or,

(iv) biological data.

Everleads does NOT collect, store or use information about minors (individuals under 18 years of age).

Everleads does NOT collect, store or use commercial information related to personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Everleads does NOT collect, store or use biometric information related to genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, face-prints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

Everleads does NOT collect, store or use information related to internet or other similar network activity including browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.

Everleads does NOT collect, store or use information related to geolocation data tracking an individual’s physical location or movements.

Everleads does NOT collect, store or use information related to sensory data which covers audio, electronic, visual, thermal, olfactory, or similar information.

Everleads does NOT collect, store or use non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). This refers to education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

Everleads does NOT collect, store, create or use inferences drawn from other personal information. We do not create profiles reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

4. Our Services and How We Use Information

We provide information to authorized resellers and third party businesses for marketing, sales, analytics and/or data management purposes. The intent of providing this information is to help marketers to deliver, target and optimize direct mail and email campaigns, display, mobile and social media marketing messages.

We may use information to help marketers and other data platforms perform “cross-channel” marketing – analyzing, locating and creating potential marketing “audiences” through multiple channels, e.g., web and mobile, or TV/radio.

In addition, when we work with online marketing applications such as through web-based, mobile, or cable TV technologies, these marketing applications may de-identify information (such as by creating a “hashed” version of an email address, or another associated identifier) in order to reach individuals through online display media. These marketing applications use cookies and similar technologies, often associated with unique online identifiers. The Purpose of our Service: We provide this service to help increase the likelihood that marketers will send relevant and desired messages, rather than unwanted offers, content, coupons and ads.

5. How We Work With and Share Data With Third Parties

Everleads may share and sell data as follows:

a. Service Providers: We may share data with service providers and/or business partners who work on our behalf, or to help us provide services requested by our customers, including to perform any of the services described in this Privacy Policy. We may share the data with these service providers in order to operate, protect and advertise our services.  For instance, we may share the Information with hosting providers, tech and customer support providers, or other data providers (to enhance or verify our data), and other companies that help us operate, improve or develop our services.

b. Partners: We may share or sell data with businesses and/or data partners (such as business partners who provide to marketers their own applications or data services) or with clients, to help provide more tailored advertising and for analytical purposes.

c. Third Party Customers: We may share or sell data to third party companies and services who provide their own data services. These customers include brands, agencies, marketing data companies and other data compilers that market and advertise to and on behalf of their own customers (and prospective customers). c. Corporate Transfers: If Everleads or its significant assets are purchased by another entity, our data will likely be transferred to that entity, including for due diligence prior to any such potential purchase. d. Other DBA’s: In addition to Everleads, other trade names registered as a DBA’s ('Doing Business As') under the Colorado corporation ListsOnline.com, Inc. include Cambridge Communications Group; Fidelity List Management; Internet Directory Publishers; and, Stanford Direct.

e. As Required by Law or to Protect Any Party: Everleads may disclose data if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) to protect or otherwise defend the rights, property or safety of Everleads or any other party.

f. Data We Collect on Our Website: We use data that you provide to us on our website for our business purposes primarily to follow up for sales and/or marketing Everleads products and/or services. For instance, if you provide us with your name and email address, we may put your into our proprietary database and send you newsletters about our company, our services, and events. We will provide you a way to opt out of these emails, usually through a link in the email footer. You can also opt out of all communications by clicking here or by sending a request to us at privacy@everleads.com.

6. Data Collected On Our Website

This website itself is primarily directed to businesses that may wish to use our services, but we welcome consumers who want to know more about our services. When you access this website or engage with us by email, we may collect the following information:

a. Personal Information:  When you provide us with information through our website, such as to request information about our services, we may request and you may provide certain PI to us. We may use your PI for any business purpose, including to administer your account and provide you services, to send communications and administrative emails, to respond to your inquiries, and to send marketing and product update messages. We may also use it to analyze how customers are using our website or services.

b. Non-Personal Information:  Whether or not you sign up for an account or provide us with PI, we may collect other information when you visit our website. This may include:

i. The type of browser and operating system you have used to access the website, a time-stamp, and other browser or device information;

ii. Your IP address (which is a number automatically assigned to your computer when you access the Internet and can be used to derive your general geographic location);

iii. Your clickstream data and any URL referral information (such as any website or social media platform that referred you to our website);

iv. What part(s) of our website you visit, click and view, and how long you view it; v. A unique identifier, which we may associate with a cookie, device identifier or similar technology.

We may collect or store the above information by using cookies, web beacons, and similar technologies, and may target or retarget ads to you using those cookies, device identifiers, or similar technologies, when you browse the Internet or use your mobile device. We may combine any information including PI you provide to us.

You can unsubscribe from our corporate emails by clicking here or by accessing the “opt out” or “unsubscribe” (or similar) link we provide in the footer of each email that we send or by sending a request to us at privacy@everleads.com. Keep in mind, however, that even if you delete your account, we may retain your PI to comply with laws, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce our agreements and policies, and take other actions permitted by law. Also, even if you unsubscribe or opt-out, we may still send you communications responding to your use of and transactions with our services.

7. Cookies, Web Pixels and Similar Technologies

This section provides more information about cookies and similar technologies that we and our business partners may use, and how they work.

a. Cookies: Cookies are small text files that websites and other online services use to store information about users on users’ own computers. For instance, cookies can be used to store sign-in credentials so that you don’t have to enter them each time you return to a website, or to store other information to make web viewing more customized or efficient upon future visits. We may work with partners to enhance our services on this website. These partners may set and access their own cookies, pixel tags and similar technologies on your device, which may have cookies with varying expiration period. Those partners may, likewise, collect various types of anonymous or de-identified information about your browser, device, or browsing activities through use of these cookies.

We also may place cookies when you open an email that we send, in order to help understand how email recipients respond to email campaigns, or to learn more (or help our clients learn more) about those recipients.

Our business partners may also use cookies and pixels, which we have no control over. For instance, we sometimes provide our data to companies that de-identify PI and associate them with online cookies or similar technologies (such as mobile identifiers). 8. Your Choices and Rights

a. Opting Out and/or Deleting Your Information from Everleads’ Database: You may click here to opt out and/or delete your information from Everleads’s database. If you decide to opt out and/or delete your information, we will remove your data from Everleads’ marketing database within ten (10) business days from the time we receive your request. When we receive a request to "opt out," "delete," or "do not sell" an individual’s information, we process that request and maintain the information in a suppression file. This ensures that the information is not added to our database in the future. If this is not your intended action, please let us know.

b. Opting Out of Your Information Being Shared with Third Parties or Online Targeting: The steps described in the section above will also opt you out of having your information shared with third parties. If you wish to opt out of other third party ad platforms and ad networks (including ones we work with and may have transferred data to in the past), we recommend visiting the opt-out pages offered by the Network Advertising Initiative and the DAA’s YourAdChoices program. Opting out through these services should cause one or more opt-out cookies to be set on your browser or device, to indicate that you have opted out. Opting out in this way won’t prevent you from seeing ads, but it will in many cases lead the companies listed to stop customizing ads based on inferences they have made about you or your interests. Note that opt-outs are browser-specific, so opting out on one browser will not affect a second browser or device that you use. For the same reason, if you buy a new device, change browsers or clear all cookies, you’ll need to perform this opt-out task again.

c. d. Unsubscribing from Our Emails: When/if we send an email to you, we will provide a way for you to opt out of receiving emails from us in the future. e. Deleting or Disabling Cookies: You may delete or disable cookies at any time through your web browser settings. However, choosing to delete or disable cookies may limit your ability to use some features on our websites and services.

9. Contact Policy

In certain instances when you enter your PI into a form on our website, such as when you request additional information about Everleads, you agree that Everleads and its subsidiaries and affiliates may use your email address and phone number for marketing and analytical purposes, including to contact you regarding Everleads services. 10. Security and Data Integrity

The security of Everleads data and your information is important to us. Everleads has implemented security measures to protect the information, both during transmission and once it is received, including without limitation, use of firewalls, application controls and encryption. No method of electronic storage or transmission over the Internet is 100% secure. So while Everleads strives to use commercially reasonable means to protect our data, we cannot guarantee complete security. We may make personal information available to third parties for their marketing purposes.  Residents from these states (and any other individuals) have the right to access, delete, correct, and/or obtain a portable copy of their personal data.

12. New Jersey Daniel’s Law

13. California Residents

If you are a California resident, the California Consumer Privacy Act (“CCPA”) provides you with specific rights regarding your personal information, *including:

(i) the right to know what information we collect, disclose, and sell;

(ii) the right to request deletion of your PI, subject to certain exceptions; and

(iii) the right to opt out of the sale of your PI.

Everleads does not collect, store or sell “Personal Information” on California residents as that term is defined in the CCPA.

All of the data Everleads sources, stores and use is “publicly available” as described by the State of California which is

(I) Information that is lawfully made available from federal, state, or local government records and/or,

(II) Information that is lawfully made available to the general public by the consumer or from widely distributed media.

Even though Everleads data is not “Personal Information” as defined by the CCPA, Everleads does follow CCPA guidelines regarding the management, storage and use of all Everleads data.

Authorized agents may be utilized by consumers to submit delete and/or opt out requests. Everleads may take certain measures to verify the consumer’s identity and that the agent has the authority to act on the consumer’s behalf. Due to our internal compliance procedures, as well as our cybersecurity policies, we reserve the right to limit the size of authorized agent bulk requests for opt-out and deletion requests. If you are an authorized agent submitting a large batch (more than 100 requests) of opt out or deletion requests at once, please reach out to us directly at privacy@everleads.com. We have batch processing options available to ensure large groups of requests can be processed effectively in compliance with our security controls. Due to limitations with email-based requests that are outside our control, bulk requests sent via email from an unknown domain may be filtered as spam or blocked by our email provider preventing successful receipt.

You have the right not to be discriminated against if you exercise any of your rights under the CCPA. CCPA rights include:

15. Residents of the European Union and United Kingdom

(i) the right to request access to your PI;

(iii) the right to restrict or delete your PI; and,

(iv) the right to object to our processing of your PI.
